When a person dies intestate (without leaving a valid will), legal heirs must establish their inheritance rights. A Legal Heir / Surviving Member Certificate is issued by revenue authorities (SDM/Tehsildar) for transferring electricity, pensions, government benefits, and mutual family settlements, whereas a Succession Certificate issued by a District Civil Court is mandatory for claiming disputed debts, securities, bank lockers, and PF accounts exceeding statutory limits.
Steps
- Identify the Required Certificate: Legal Heir (Revenue) vs. Succession Certificate (Civil Court)
- Obtain Death Certificate and Prepare Family Tree (Shajra-e-Nasab / Vanshavali)
- Execute Joint Notarized Affidavit on Non-Judicial Stamp Paper
- Submit Application and Undergo Revenue Inquiry / Local Panchnama
- Public Notice and Certificate Issuance
